A three-judge panel of a state appeals court is agreeing with a Franklin County judge, determining that the state’s EdChoice program is unconstitutional.
The program continues as the court process moves on with an appeal to the Ohio Supreme Court.
EdChoice helps pay for tuition at private schools for students who would otherwise attend a poorly-performing public school.
The panel said the program creates a separate school system in the state.
